1. Who you are contracting with

This website, rockfordwatches.com (the "Site"), and the store operating under the name Rockford Watches, are operated by Soufiane Bousta, a sole trader established in Belgium, trading as SB Group.

In these Terms, "we", "us" and "our" refer to Soufiane Bousta trading as SB Group. "You" refers to the person placing an order or using the Site.

By accessing the Site or placing an order, you agree to these Terms of Service. If you do not agree, do not use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority in your state of residence, to place an order. By placing an order you confirm that you meet this requirement and that the payment method you use belongs to you or that you are authorized to use it.

3. Where we sell

We sell and ship to addresses in the United States only. Orders placed for delivery outside the United States will be cancelled and refunded.

4. Products and availability

We are an independent online retailer. We are not an authorized dealer for, and we are not affiliated with or endorsed by, any watch manufacturer or brand. We do not sell branded or licensed luxury watches.

Product listings, images and descriptions are provided for the purpose of identifying the item offered. Colors may appear differently depending on your screen.

Listings are an invitation to order, not a binding offer. We may limit quantities, refuse an order, or cancel an order at any time before dispatch, including where an item is unavailable, where a listing contained an error in price or description, or where we suspect fraudulent or abusive use of the Site. If we cancel an order after payment, we refund the full amount charged.

5. Prices and payment

All prices are displayed in US dollars (USD).

The price shown on the product page is the total price you pay. We add no handling fee and no shipping charge. We do not currently collect US sales tax at checkout. If we become required to collect it, it will be calculated and shown at checkout before you pay.

Orders ship on a Delivered Duty Paid (DDP) basis. US import duties and customs fees are included in the price you pay at checkout and are settled by us before your parcel clears US customs. You will not be asked to pay duties, taxes or brokerage fees to the carrier on delivery.

We accept the payment methods displayed at checkout. Payment is processed by Shopify Payments and by the payment providers shown at checkout. We do not receive or store your full card details.

Your order is accepted when we send you an order confirmation by email.

6. Shipping

Shipping terms, timeframes and cancellation rights are set out in our Shipping Policy, which forms part of these Terms.

7. Returns and refunds

Return and refund terms are set out in our Refund and Return Policy, which forms part of these Terms.

8. Cancelling an order

You may cancel an order at no cost as long as it has not yet been dispatched. Email contact@rockfordwatches.com with your order number. Where an order is cancelled before dispatch, we refund your original payment method within 7 business days, or within one billing cycle if you paid by credit card. Once an order has been dispatched, our Refund and Return Policy applies.

9. Your account

If you create an account, you are responsible for keeping your login details confidential and for activity carried out under your account. Tell us promptly if you believe your account has been used without your authorization. We may suspend or close an account used in breach of these Terms.

10. Acceptable use

You agree not to use the Site to break any law, to infringe anyone's rights, to transmit malicious code, to scrape or copy the Site for a competing service, to interfere with the operation or security of the Site, or to submit false information.

11. Intellectual property

The Site, its text, layout, graphics and the Rockford Watches name are owned by us or used under licence, and are protected by applicable intellectual property law. You may not reproduce or reuse them commercially without our prior written consent.

12. Content you submit

If you submit a review, photo, comment or other content, you grant us a non-exclusive, royalty-free, worldwide licence to display and reproduce it in connection with the Site and our marketing. You confirm the content is yours to share and does not infringe anyone's rights. We may remove any submitted content at our discretion.

13. Third-party links

The Site may link to third-party websites. We do not control them and are not responsible for their content, products or privacy practices.

14. Disclaimer

The Site is provided on an "as is" and "as available" basis. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. To the fullest extent permitted by law, we disclaim all implied warranties, including implied warranties of merchantability and fitness for a particular purpose.

Some states do not allow the exclusion of implied warranties. In those states, the exclusions above apply only to the extent permitted by the law of that state, and nothing in these Terms affects rights you have that cannot be waived under applicable law.

15. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or in connection with an order is limited to the amount you paid for that order.

We are not liable for indirect, incidental, special or consequential damages, or for loss of profit, revenue or data.

Some states do not allow the limitation or exclusion of incidental or consequential damages. In those states, the limitations above apply only to the extent permitted by the law of that state.

Nothing in these Terms excludes liability for fraud, for death or personal injury caused by our negligence, or for any other liability that cannot lawfully be excluded.

16. Indemnity

You agree to indemnify us against claims, losses and reasonable costs arising from your breach of these Terms or your unlawful use of the Site.

17. Events outside our control

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including carrier disruption, customs delay, natural events, strikes, or failure of public or private telecommunications networks. Where such an event delays your order, our Shipping Policy sets out your right to be notified and to cancel.

18. Changes to these Terms

We may update these Terms. The version in force is the one published on this page at the time you place your order, identified by the "Last updated" date above. Changes do not apply retroactively to orders already placed.

19. Severability and waiver

If a provision of these Terms is found unenforceable, the remaining provisions stay in force. Our failure to enforce a provision is not a waiver of it.

20. Governing law and disputes

These Terms are governed by Belgian law. The courts of Brussels, Belgium have jurisdiction over any dispute arising from them.

This does not deprive you of the protection of any mandatory consumer-protection law of your state of residence in the United States, and does not prevent you from bringing a claim before a court that has jurisdiction over you under that law.

21. Entire agreement

These Terms, together with the Refund and Return Policy, the Shipping Policy and the Privacy Policy, form the entire agreement between you and us in relation to your order.
